Hospitality (Book Excerpt)\t\t<\/p>\n<\/h3><\/div>\n<p><time class=\"c-timestamp  \" datetime=\"00:00-YY-DD-MM\"><\/p>\n<p><\/time><\/p><\/div>\n<p>\t\t<\/a><\/p>\n<\/div><\/div>\n<\/div>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAccording to the <em><a href=\"https:\/\/apnews.com\/article\/live-nation-antitrust-trial-closing-arguments-2194691c4075a08e7483d78eb17ec77a\" rel=\"nofollow\" target=\"_blank\">Associated Press<\/a><\/em>, the states\u2019 lawyer, <strong>Jeffrey Kessler<\/strong>, told the jury in his final pitch on Thursday that Live Nation is a \u201cmonopolistic bully.\u201d Kessler said the company controls 86% of major concert venues in addition to the artist promotion and ticketing business \u2014 a level of control he equated to \u201cdigging the moat around the monopoly castle.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tLive Nation attorney <strong>David Marriott <\/strong>countered in his own closing statement that while the company is indeed big, it is a \u201cfierce competitor\u201d that plays fair in the live entertainment industry. He said the states do not have any tangible evidence of monopolistic conduct, and that Kessler\u2019s 86% figure is a misleading number calculated by excluding key venues, such as stadiums, from the pool of \u201cmajor concert venues.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cThis is a gerrymandered market made up for purposes of this litigation,\u201d Marriott told the jury, per the <em><a href=\"https:\/\/www.nytimes.com\/2026\/04\/09\/arts\/music\/live-nation-antitrust-suit-closing-arguments.html\" rel=\"nofollow\" target=\"_blank\">New York Times<\/a><\/em>.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe lengthy trial featured testimony from venue bosses including former Barclays Center CEO <strong>John Abbamondi<\/strong>, who said Live Nation CEO <strong>Michael Rapino<\/strong> <a href=\"https:\/\/www.billboard.com\/pro\/live-nation-doj-trial-week-1-recap-taylor-swift-opening\/\">threatened to divert concerts<\/a> if he switched to rival ticketer SeatGeek. Rapino denied making such threats when he later <a href=\"https:\/\/www.billboard.com\/pro\/live-nation-doj-trial-week-2-recap-michael-rapino-slack\/\">took the stand himself<\/a>, saying the company has achieved its success through top-notch work, not anticompetitive conduct.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tOther key witnesses included AEG Presents CEO <strong>Jay Marciano<\/strong>, Live Nation president of touring <strong>Omar Al-joulani<\/strong> and <a href=\"https:\/\/www.billboard.com\/artist\/drake\/\">Drake<\/a>\u2019s manager, <strong>Adel Nur <\/strong>(aka Future the Prince). On a technical level, the verdict form asks whether Live Nation violated federal and state antitrust laws via two key practices: requiring artists to use its promotion services in order to play its amphitheaters, and threatening to withhold Live Nation-promoted concerts from venues that don\u2019t sign exclusive primary ticketing contracts with Ticketmaster.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tFinancial damages could be on the table if the jury\u2019s answer is \u201cyes\u201d to any of these questions. It would then be up to Judge Arun Subramanian to decide what kind of structural relief is required. The states want to break up Live Nation and Ticketmaster, but the judge could find that limits on the company\u2019s business practices are sufficient.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tLive Nation has already agreed to some such limits as part of its settlement with the DOJ, including opening up its back-end technology to rival ticketers, allowing rival promoters to book its amphitheaters and offering a non-exclusive primary ticketing option to venues.
