Google will happily <a href=\"https:\/\/futurism.com\/future-society\/homeland-security-google\">comply with administrative subpoenas<\/a> issued by Department of Homeland Security apparatchiks.<\/p>\n<p class=\"article-paragraph skip\">A new ruling by a New York federal judge now definitively includes AI chatbots in that list. As part of a <a href=\"https:\/\/www.reuters.com\/legal\/government\/ex-gwg-chair-charged-with-securities-fraud-doj-says-2025-11-05\/\">protracted legal battle<\/a> involving Brad Heppner, former chair of financial service company GWG Holdings, US District Judge Jed Rakoff ruled that AI chatbots aren\u2019t subject to attorney-client privilege.<\/p>\n<p class=\"article-paragraph skip\">Maybe that sounds like a no-brainer, but evidently some people need the reminder. In preparing background materials for his attorneys, Heppner made the wise decision to enter various reports into Anthropic\u2019s flagship chatbot Claude. The AI then spat out the preliminary reports, which his lawyers used to prepare his defense related to charges of securities and wire fraud, <a href=\"https:\/\/www.reuters.com\/legal\/government\/ai-ruling-prompts-warnings-us-lawyers-your-chats-could-be-used-against-you-2026-04-15\/\">as <em>Reuters<\/em> reported<\/a>.<\/p>\n<p class=\"article-paragraph skip\">The problem is that while <a href=\"https:\/\/www.law.cornell.edu\/wex\/attorney-client_privilege\">attorney-client privilege<\/a> protects most information exchanged between Heppner and his lawyers, it doesn\u2019t extend to anything he jammed into Claude. As a result, the embattled financier is being forced to hand over 31 documents generated by Claude to the court.<\/p>\n<p class=\"article-paragraph skip\">In <a href=\"https:\/\/fingfx.thomsonreuters.com\/gfx\/legaldocs\/xmvjyjekkpr\/Rakoff%20-%20order%20-%20AI.pdf\">his opinion<\/a>, Rakoff wrote that no attorney-client relationship exists \u201cor could exist, between an AI user and a platform such as Claude.\u201d The judge went even further, absolving the chatbot from any impropriety, because \u201cClaude disclaims providing legal advice.\u201d<\/p>\n<p class=\"article-paragraph skip\">\u201cIndeed, when the Government asked Claude whether it could give legal advice, it responded that \u2018I\u2019m not a lawyer and can\u2019t provide formal legal advice or recommendations\u2019 and went on to recommend that a user \u2018should consult with a qualified attorney who can properly assess your specific circumstances,&#8217;\u201d Rakoff further explained.<\/p>\n<p class=\"article-paragraph skip\">Heppner\u2019s alleged fraud notwithstanding, the ruling has major implications for AI chatbot users who could now be incriminating themselves, whether they know it or not.<\/p>\n<p class=\"article-paragraph skip\">The finding is already reverberating around law offices, according to <em>Reuters<\/em>. The white-collar defense firm Sher Tremonte, for example, updated its contract to reflect that \u201cdisclosure of privileged communications to a third-party AI platform may constitute a waiver of the attorney-client privilege.\u201d <\/p>\n<p class=\"article-paragraph skip\">Again, tech companies handing personal data to Uncle Sam \u2014 willingly or otherwise \u2014 <a href=\"https:\/\/hir.harvard.edu\/big-data-in-policing\/\">is nothing new<\/a>.
