The two cofounded OpenAI back in 2015 as a nonprofit with an ostensibly altruist mission. But then Musk <a href=\"https:\/\/futurism.com\/the-byte\/elon-musk-quits-research-group\">stormed out of the company<\/a> three years later. Reportedly, it was because he beefed with Altman\u2019s leadership.<\/p>\n<p class=\"article-paragraph skip\">There\u2019s been bad blood between them ever since \u2014 a lot of which has been playing out in the courts.<\/p>\n<p class=\"article-paragraph skip\">In 2024, Musk <a href=\"https:\/\/futurism.com\/elon-musk-sues-openai\">sued OpenAI and Altman<\/a> for violating its founding principles by pursuing profits over the public good. As the lawsuit dragged on, he then tried to get a federal judge to block OpenAI\u2019s restructuring from a non-profit into a purely for-profit company. The judge swatted down Musk\u2019s plea, but OpenAI has since given up on becoming an out-and-out for-profit. It\u2019s now trying to convert into a public benefit corporation, but with <a href=\"https:\/\/futurism.com\/openai-signs-of-crisis\">similar struggles that are tying up billions of dollars in cash it needs from its investors<\/a>.<\/p>\n<p class=\"article-paragraph skip\">For whatever reason, Musk dropped the original suit \u2014 but is now suing Altman and his company again <a href=\"https:\/\/www.nytimes.com\/2024\/08\/05\/technology\/elon-musk-openai-lawsuit.html\">for basically the same reason<\/a>.\u00a0<\/p>\n<p class=\"article-paragraph skip\">If that series of moves from Musk reek of jealousy that his friend-turned-foe now commands the most important AI company in the world which is being valued at half a trillion dollars, a brand new lawsuit filed this week by Musk\u2019s company xAI seems driven by rage that Altman keeps poaching his talent.<\/p>\n<p class=\"article-paragraph skip\">As <a href=\"https:\/\/www.theguardian.com\/technology\/2025\/sep\/25\/elon-musk-xai-openai-sam-altman-lawsuit\" rel=\"nofollow\"><em>The Guardian <\/em>reports<\/a>, the suit filed in a California court accuses OpenAI of a \u201cdeeply troubling pattern\u201d of hiring former xAI employees to gain access to its trade secrets, including the source code behind its prized chatbot Grok. Seemingly, OpenAI is just dying to know how to make an AI that goes haywire and <a href=\"https:\/\/futurism.com\/grok-mechahitler-meltdown-xai-government-contract\">starts calling itself \u201cMechaHitler<\/a>.\u201d<\/p>\n<p class=\"article-paragraph skip\">\u201cOpenAI is targeting those individuals with knowledge of xAI\u2019s key technologies and business plans, including xAI\u2019s source code and its operational advantages in launching data centers, then inducing those employees to breach their confidentiality and other obligations to xAI through unlawful means,\u201d the lawsuit alleges, per the newspaper.<\/p>\n<p class=\"article-paragraph skip\">Hiring a rival\u2019s ex-employees isn\u2019t illegal in itself, but it is at least one way of conducting corporate espionage. An aggrieved corporation would have to prove that there\u2019s a concerted, systematic effort to snipe a rival\u2019s talent, however, which is what Musk and xAI are alleging.<\/p>\n<p class=\"article-paragraph skip\">The allegations emerged from xAI investigating its former engineer Xuechen Li for stealing trade secrets. Amid that probe, Musk\u2019s company says it uncovered a \u201cdeliberate scheme\u201d to steal these secrets by hiring eight former xAI employees, <a href=\"https:\/\/www.theinformation.com\/briefings\/xai-sues-openai-allegedly-stealing-trade-secrets?rc=st1fhw\" rel=\"nofollow\">per <em>The Information<\/em><\/a>.<\/p>\n<p class=\"article-paragraph skip\">Along with Li, OpenAI also poached former xAI engineer Jimmy Fraiture and another senior finance executive, the company alleged.<\/p>\n<p class=\"article-paragraph skip\">That accused finance executive didn\u2019t take kindly to the allegations. When Musk\u2019s lawyer sent them an email accusing them of breaching their confidentiality agreement, according to a screenshot in the lawsuit, they had a one sentence rebuttal.<\/p>\n<p class=\"article-paragraph skip\">\u201cSuck my dick,\u201d the employee responded.<\/p>\n<p class=\"article-paragraph skip\">In not quite those same words, OpenAI also denied the allegations, calling it the \u201clatest chapter in Mr Musk\u2019s ongoing harassment.\u201d Along with the lawsuits already mentioned, Musk is <a href=\"https:\/\/www.reuters.com\/legal\/litigation\/elon-musks-xai-sues-apple-openai-over-ai-competition-app-store-rankings-2025-08-25\/\">also suing OpenAI and Apple<\/a>, accusing the two companies last month of colluding to keep ChatGPT at the top of the App Store while stopping its Grok app from climbing the charts.<\/p>\n<p class=\"article-paragraph skip\">While we wouldn\u2019t put it past OpenAI, a company that so nakedly <a href=\"https:\/\/futurism.com\/openai-sleazy-company-creating-agi\">dropped its open-source and non-profit act<\/a> the second it smelled Microsoft money, of engaging in nefarious practices, it\u2019s pretty rich for Musk to be mad about his employees fleeing to competitors, innocently or otherwise. He\u2019s notorious for <a href=\"https:\/\/futurism.com\/elon-musk-wanders-tesla-factory-firing-workers\">rage-firing employees on the spot<\/a> and treating the ones that don\u2019t worship the ground he walks on <a href=\"https:\/\/futurism.com\/free-speech-elon-musk-fires-employees\">poorly<\/a>.
