{"id":5942,"date":"2025-10-14T17:20:31","date_gmt":"2025-10-14T17:20:31","guid":{"rendered":"https:\/\/musictechohio.online\/site\/openai-danger-authors-internal-slack-messages\/"},"modified":"2025-10-14T17:20:31","modified_gmt":"2025-10-14T17:20:31","slug":"openai-danger-authors-internal-slack-messages","status":"publish","type":"post","link":"https:\/\/musictechohio.online\/site\/openai-danger-authors-internal-slack-messages\/","title":{"rendered":"OpenAI in Danger After Authors Suing It Gain Access to Its Internal Slack Messages"},"content":{"rendered":"<div>\n<p class=\"article-paragraph skip\">Last month, AI company Anthropic <a href=\"https:\/\/www.cbc.ca\/news\/business\/anthropic-ai-copyright-settlement-1.7626707\" rel=\"nofollow\">agreed to a blockbuster $1.5 billion settlement<\/a> after being caught red-handed training its models on an enormous cache of pirated versions of copyrighted books and other material.<\/p>\n<p class=\"article-paragraph skip\">Now, a similar lawsuit aimed at ChatGPT maker OpenAI has taken a dramatic turn, raising the possibility of yet another major legal escalation regarding AI-facilitated copyright infringement \u2014 and a potentially much bigger payout to rightsholders.<\/p>\n<p class=\"article-paragraph skip\">Specifically, authors and publishers who filed a lawsuit against the Sam Altman-led firm have secured access to internal Slack messages and emails discussing the mass deletion of a pirated books dataset, <a href=\"https:\/\/news.bloomberglaw.com\/ip-law\/openai-risks-billions-as-court-weighs-privilege-in-copyright-row\" rel=\"nofollow\"><em>Bloomberg <\/em>reports<\/a>. A New York district court <a href=\"https:\/\/news.bloomberglaw.com\/ip-law\/openai-must-produce-slack-messages-about-ip-risks-data-deletion\" rel=\"nofollow\">ordered<\/a> OpenAI to hand over the communications regarding data deletion last week.<\/p>\n<p class=\"article-paragraph skip\">According to the publication, the communications could demonstrate willful infringement, potentially leading to enhanced damages of up to $150,000 per work, a massive increase from just $750.<\/p>\n<p class=\"article-paragraph skip\">For context: Anthropic\u2019s settlement only covered around half a million works out of an estimated seven million, resulting in a payout of <a href=\"https:\/\/www.npr.org\/2025\/09\/05\/nx-s1-5529404\/anthropic-settlement-authors-copyright-ai\" rel=\"nofollow\">around $3,000 per author<\/a>. Authors and publishers had just gone after similar communications \u2014 right before the case settled.<\/p>\n<p class=\"article-paragraph skip\">\u201cFinding out what attorneys said or what clients said to attorneys and back and forth probably gives us a lot of evidence regarding state of mind,\u201d Hamline University professor David Schultz told <em>Bloomberg<\/em>.<\/p>\n<p class=\"article-paragraph skip\">The lawsuit highlights the AI industry\u2019s largely careless treatment of copyrighted materials. Tech leaders have continued to argue that training AI models on <a href=\"https:\/\/futurism.com\/openai-over-copyrighted-work\">protected content falls under \u201cfair use<\/a>,\u201d a legal doctrine that allows for <a href=\"https:\/\/copyright.psu.edu\/copyright-basics\/fair-use\/\" target=\"_blank\" rel=\"noreferrer noopener\">transformative use of copyrighted materials<\/a>.<\/p>\n<p class=\"article-paragraph skip\">Most recently, OpenAI\u2019s TikTok-like text-to-video app Sora 2 has been found to spit out a litany of videos <a href=\"https:\/\/futurism.com\/future-society\/openai-sora-2-spongebob-cooking-meth-copyright\">heavily based on protected intellectual property<\/a>, showing it\u2019s not just ChatGPT potentially infringing copyright. (Sloppily-implemented guardrails have since <a href=\"https:\/\/futurism.com\/artificial-intelligence\/openai-sora-trouble-backlash-copyright\">stemmed the tide<\/a> somewhat, but users are easily finding ways around them.)<\/p>\n<p class=\"article-paragraph skip\">Given the major payouts at stake, the tides could be turning in favor of artists who had their lifework sucked up by AI models without permission, who could be looking at another consolation prize in the form of a settlement fee.<\/p>\n<p class=\"article-paragraph skip\">Both Anthropic and OpenAI have been accused of training their AI models on copyrighted materials uploaded to a piracy website called LibGen.<\/p>\n<p class=\"article-paragraph skip\">Communications show that OpenAI deleted the dataset, a move that plaintiffs argue could be construed as <a href=\"https:\/\/sherwood.news\/power\/openais-internal-slack-messages-could-cost-them-billions-in-copyright-suit\/\" rel=\"nofollow\">intentional destruction of evidence<\/a>. Judge Ona Wang has already found that OpenAI improperly withheld materials, per <em>Bloomberg<\/em>.<\/p>\n<p class=\"article-paragraph skip\">While it remains to be seen how the internal communications will influence the case, experts argue that it could allow plaintiffs to build a stronger case.<\/p>\n<p class=\"article-paragraph skip\">\u201cThere may be a smoking gun, we don\u2019t know,\u201d Saint Louis University law professor Yvette Joy Liebesman told <em>Bloomberg<\/em>.
