Just when you thought you\u2019ve seen it all, Meta comes out and accuses a random man of hosting a trove of illegally torrented smut.<\/p>\n

The whole thing started with a July lawsuit<\/a> by an adult film companies Strike 3 \u2014 which has been called<\/a> the \u201cmost active copyright litigant in the United States\u201d \u2014 and Counterlife Media.<\/p>\n

To make a long story short, the two rightsholders essentially accused Meta of illegally torrenting<\/a> some 2,400 skin flicks to train its AI systems. Their civil suit seeks a combined $359 million in damages, and alleges Meta could be developing a secret \u201cadult version\u201d of its generative AI software, Movie Gen<\/a>.<\/p>\n

It wouldn\u2019t exactly be uncharacteristic of Meta, which was found to have fed over seven million<\/a> illegally-pirated books, articles, and magazines into its AI earlier this year. There\u2019s also the smoking gun to consider \u2014 as the copyright industry publication TorrentFreak<\/em> reported<\/a>, Meta was caught with their pants down hosting 47 IP addresses linked to the illegal distribution of all those dirty movies.<\/p>\n

Yet to hear the tech giant tells it, the videos were actually downloaded \u201cfor private personal use,\u201d as flagged by Gizmodo<\/em><\/a>. The counter-argument came via Meta\u2019s motion to dismiss the case, as part of a claim that the 2,400 video files in question aren\u2019t enough to develop a workable AI model.<\/p>\n

\u201cThe small number of downloads \u2014 roughly 22 per year on average across dozens of Meta IP addresses \u2014 is plainly indicative of private personal use, not a concerted effort to collect the massive datasets Plaintiffs allege are necessary for effective AI training,\u201d Meta quarreled.<\/p>\n

A Meta spokesperson told Giz <\/em>that the company doesn\u2019t \u201cwant this type of content,\u201d adding that it takes \u201cdeliberate steps to avoid training on this kind of material.\u201d<\/p>\n

Yet its motion to dismiss goes even farther.<\/p>\n

\u201c[Strike 3] points to 97 additional downloads made using the home IP address of a Meta contractor\u2019s father, but plead no facts plausibly tying Meta to those downloads, which are plainly indicative of personal consumption,\u201d the filing alleged.<\/p>\n

In other words, Meta\u2019s arguing that it isn\u2019t their professional goon stash \u2014 but instead some worker\u2019s dad whose torrenting habit happened to be detected in a sweep of illegal activity on IP addresses related to its corporate activities. Whether that excuse adds up will be a matter for the court, but in the meantime, it\u2019s a pretty humiliating reminder to use a VPN.<\/p>\n
