Say what you will about AI chatbots<\/strong>, but there\u2019s no question they\u2019re now affecting the real world \u2014 including imploding your marriage.<\/p>\n

We\u2019ve talked pretty extensively about all the alarming ways that AI is disrupting people\u2019s personal lives, including serving as a delusion-prone person\u2019s own little cult leader<\/a>, a friend or romantic companion for lonely teens and adults<\/a>, and as a chaotic therapist that\u2019s blowing up people\u2019s marriages<\/a>.<\/p>\n

But can a spouse \u201ccheat\u201d on you with an AI companion? That\u2019s the big question hanging over marriage law right now, Wired <\/em>reports<\/a>, as more and more disgruntled partners are citing their significant other\u2019s AI paramour as grounds for a divorce.<\/p>\n

\u201cThe law is still developing alongside these experiences,\u201d divorce attorney Rebecca Palmer told the magazine. \u201cBut some people think of it as a true relationship, and sometimes better than one with a person.\u201d<\/p>\n

Palmer\u2019s firm has worked with clients who have gotten or are seeking a divorce because of their partner cheating on them with AI, including an ongoing case in which the accused spouse blew money on \u2014 and, astoundingly, shared private information like bank accounts and social security numbers with \u2014 a chatbot.<\/p>\n

The conundrum is giving judges a headache, as they already \u201cstruggle with what to do about affairs with humans,\u201d Palmer added.<\/p>\n

Raising the stakes \u2014 and also complicating the path to reaching a broader consensus on this emerging issue \u2014\u00a0in some states, cheating on a spouse is literally illegal. In Michigan, Wisconsin, and Oklahoma, adultery is a felony charge punishable with up to five years in prison or a fine up to $10,000, Wired<\/em> noted.<\/p>\n

Should a partner\u2019s AI obsession, for example, be justification for losing the kids? In custody battles, \u201cit is conceivable and likely\u201d that judges would call a parent\u2019s judgment into question if \u201cthey\u2019re having intimate discussions with a chatbot,\u201d Palmer told Wired<\/em>, which also \u201cbrings into question how they are spending time with their child.\u201d<\/p>\n

Elizabeth Yang, a family law attorney in California, predicts that we\u2019ll see a boom in divorce filings as more people fall for their AI lovers, similar to how there was an uptick in divorces during the COVID pandemic, she said.<\/p>\n

\u201cAs [AI] continues improving, becoming more realistic, compassionate, and empathetic, more and more people in unhappy marriages who are lonely are going to be going to seek love with a bot,\u201d Yang told Wired<\/em>.<\/p>\n

Yang\u2019s prediction appears to be on the money. Wired<\/em> notes that in the UK, a partner\u2019s emotional attachment to an AI chatbot has already become a more common factor in a divorce, according to data from Divorce-Online.<\/p>\n

It\u2019s hard to say which way the winds will blow. But some legislators are already trying to draw a line in the sand. Ohio, for example, is attempting to ban human-AI marriages<\/a> by affirming that AIs are \u201cnonsentient entities\u201d that do not have personhood.<\/p>\n
