Anthropic CEO Dario Amodei picked a major fight<\/a> with the Department of Defense last month, asserting that his company\u2019s AI models couldn\u2019t be used for mass surveillance of Americans or direct autonomous weapons systems.<\/p>\n

Defense secretary Pete Hegseth and president Donald Trump lambasted Amodei for dictating what they could or couldn\u2019t do with the company\u2019s tech. They quickly announced that the company would be labeled a supply chain risk \u201ceffective immediately,\u201d in sanctions conventionally reserved for companies from adversary countries.<\/p>\n

It was an unprecedented move that sent shockwaves across Silicon Valley<\/a>, with a coalition of tech industry groups signing a public letter condemning the decision. Even Amodei\u2019s top rival, OpenAI CEO Sam Altman, argued<\/a> that the Trump administration had overstepped by labelling Anthropic\u2019s tech non grata. Anthropic risks losing hundreds of millions of dollars\u2019 worth of US government contracts.<\/p>\n

While Amodei has since issued an apology<\/a> for pushing back against Trump<\/a> in a note to staffers that was leaked to The Information<\/em><\/a>, Anthropic is now ready to challenge the White House\u2019s latest designation in court. As Wired<\/em> reports<\/a>, Anthropic filed a federal lawsuit against the Pentagon on Monday, challenging its move to label it a \u201csupply chain risk.\u201d<\/p>\n

As Amodei noted in his blog post, \u201cwe do not believe this action is legally sound, and we see no choice but to challenge it in court.\u201d<\/p>\n

In the company\u2019s lawsuit<\/a>, filed in a California court, it argues that White House officials acted unconstitutionally and out of retaliation.<\/p>\n

\u201cThe Constitution does not allow \u200bthe government to wield its enormous power to punish a company for its protected speech,\u201d the lawsuit reads. \u201cAnthropic turns to the judiciary as a last resort to vindicate its rights and halt the Executive\u2019s unlawful campaign of retaliation.\u201d<\/p>\n

But experts believe Anthropic may have a very difficult road ahead.<\/p>\n

For one, \u201cit\u2019s 100 percent in the government\u2019s prerogative to set the parameters of a contract,\u201d Snell & Winter partner Brett Johnson told Wired<\/em>, effectively meaning there may be very little chance of an appeal. <\/p>\n

Johnson argued it\u2019s in Anthropic\u2019s best interest to argue in court that it was singled out among the US government\u2019s other AI contractors.<\/p>\n

While the Pentagon has officially ratified its decision to name Anthropic a supply chain risk, the company\u2019s Claude chatbot continues to be widely used in the US war on Iran<\/a>, meaning the Department of Defense is now using compromised tech by its own admission.<\/p>\n

Government agencies outside of the military have revealed they would immediately follow the direction of the president and stop using Claude. A Microsoft spokesperson also told Wired<\/em> that it will continue to offer the chatbot to all other agencies, except for the Defense Department.<\/p>\n

The lawsuit may greatly complicate efforts to bury the hatchet.<\/p>\n

\u201cAnthropic has much more in common with the Department of War than we have differences,\u201d Amodei wrote in his apology. \u201cWe both are committed to advancing US national security and defending the American people, and agree on the urgency of applying AI across the government.\u201d<\/p>\n

But the lawsuit itself takes a dramatically different tone. The Trump administration\u2019s actions \u201care as unlawful as they are unprecedented,\u201d the document reads, calling out Hegseth specifically for sidestepping Congress.<\/p>\n

\u201cThe Challenged Actions inflict immediate and irreparable harm on Anthropic,\u201d the lawsuit reads. \u201cOn others whose speech will be chilled; on those benefiting from the economic value the company can continue to create; and on a global public that deserves robust dialogue and debate on what AI means forwarfare and surveillance.\u201d<\/p>\n
